Civil Case Outcomes: Theory and Reality

What are the outcomes in civil cases? We all know that the traditional legal research method — reading opinions — cannot answer this question entirely. This panel will consider the theory and reality of civil case resolutions using a variety of perspectives and social science tools. The panelists have all conducted research that sheds light on some aspect of case outcomes: sociological research using quantitative and qualitative data; psychological research using experimental methods; econometric modeling; and political science inquiry into the covariates of various types of judicial decisions. The panelists will describe their own research on case outcomes, highlighting the methodological advantages and challenges of their chosen approach.
