    Liability for Intermediaries Under Copyright and Trademark Law

    As digital networks and new business models make it harder for intellectual property owners to enforce their rights effectively against the primary users of their property, copyright and trademark owners are increasingly looking to sue intermediaries typically (though not exclusively) under theories of secondary liability. This session will examine the various grounds on which intermediaries might be held liable for copyright and trademark infringement, the role of safe harbors and other devices for ensuring a climate in which intermediaries can facilitate socially useful activity, and what effect the liability of intermediaries might have on innovative technological development or on our cultural environment.
