    The summer of 2023 was commonly referred to as Hot Labor Summer – and for good reason. Almost half a million workers have gone on strike so far in 2023, compared with just a tenth of that number at this point just two years ago.

    However, political divisions within our legal institutions have not changed. In Glacier Northwest v. Teamsters, the Supreme Court held that workers could be sued for tort claims in state court for risking harm to an employer’s property, while the Biden Board has repeatedly moved in employee-protective directions.

    Here, labor law academics and practitioners reflect on this cultural moment in United States labor relations, focusing on the regulation of strikes and collective bargaining agreements throughout history.
