Sessions Description

  • The panel "Islamic Law & the Question of Palestine" will explore the connections between Islamic legal principles and the pursuit of justice in the context of Palestine. The discussion will focus on the concepts of justice and rights within Islamic jurisprudence concerning land, occupation, self-determination, and conflict. Topics to be addressed include: the intersections and tensions between modern international law and Islamic law, he legal status of Jerusalem and the holy sites (al-Quds and al-Haram al-Sharif) within Islamic jurisprudence, the Islamic legal obligations to resist oppression, the role of Islamic legal thought in addressing the rights of refugees and the right of return, and how Islamic legal traditions might inform models for accountability, reparations, and reconciliation.
