On June 23, 2022, the Supreme Court handed down its first major Second Amendment decision in 12 years in New York State Rifle & Pistol Association v. Bruen. Bruen’s focus on history opens up a new set of scholarly questions: At what level of generality will judges apply Bruen’s historical-analogue test? Are lower courts equipped to conduct historical analysis? Is there room for modern-day empirical evidence within the Bruen framework? Join Darrell Miller, George Mocsary, Kami Chavis, and Brannon Denning for an engaging discussion that will unpack Bruen, explore these questions, and consider the future course of Second Amendment jurisprudence.
