The California marriage litigation and subsequent federal lawsuit highlight a particular tension in family law: equal treatment and full faith and credit on one hand and the value of preserving states as laboratories for experimentation where new and different forms of family recognition can be developed, on the other. Similarly transgender persons have achieved some successes in individual states, but are hampered by lack of national uniformity regarding legal sex, which produces uncertainty on issues of marriage and child custody. In addition, this panel reflects on constitutional change by considering issues raised by the marriage litigation such as the appropriate level of scrutiny and the problem of differentiating between animus and morality.
