Following the passage of the Class Action Fairness Act (CAFA), choice of law issues have assumed an increasing importance in class action litigation. Some federal courts have denied certification on the grounds that choice of law analysis points to many different states’ substantive laws. Others have found ways to decide all claims under a single law.  This panel will discuss, from a variety of perspectives, the emerging caselaw and the future prospects for choice of law in complex litigation.
