    E-Discovery: A Litigation Revolution?

One or more presenters were selected from a call for papers.

The ever-increasing use of electronically-stored information has impacted discovery in civil litigation, leading to the recent amendments to the rules of procedure, as well as to significant case law on discovery obligations and sanctions. Some commentators have claimed that E-Discovery has resulted in the biggest change in civil litigation since the Federal Rules of Civil Procedure were instituted, bringing with them the age of notice pleading and decreased judicial involvement in pretrial practice. This panel will explore the impact that E-Discovery has and will have on civil litigation, as well as how it has or should impact the way discovery and civil procedure are taught in law schools today. Panelists will present the federal and state perspectives, as well as the judicial and academic views.
