As Americans increasingly turn to arbitration to resolve disputes, many have begun to question whether arbitration provides a just and effective resolution in all cases. This panel will discuss the particular concerns of arbitration and the older client. One presentation will address whether courts seem to be using vulnerability as a condition that should limit arbitrability. Another will examine the use of unconscionability as a limit on ordering arbitration. One presenter will provide a general update on some recent decisions/legislation, and how they impact companies’ ability to impose arbitration on older persons. The final presenter will be chosen from the responders to a call for papers.
