The electronic revolution has transformed many aspects of American society during the last two decades, and the realm of litigation is no exception.  E-discovery, the subject of prior programs in law schools and at AALS meetings, continues to raise many vexing issues concerning, among other things, preservation and costs.  The manner of and use of electronic technology at trial is another aspect of the transformation.  So too is the increased use of electronic pretrial techniques such as videoconferenced depositions.  And there are many other facets as well, such as the admissibility of electronic records including electronic business records.

Capitalizing on the location of this year’s conference in one of the electronic/technology centers of the world, we hope to bring together speakers and commentators who have been doing serious empirical and qualitative analysis of these kinds of issues.  Among those who will be presenting are Mr. Withers, the Director of Judicial Education and Content for The Sedona Conference, an Arizona-based nonprofit law and policy think tank, which has been on the forefront of complex litigation, and (hopefully) Mr. Baron, head of litigation at the National Archives in DC, who has worked extensively on “data deluge” and its impact on litigation.
