    Real Estate Transactions in Troubled Times

    One or more presenters were selected from a call for papers.

    In the wake of the national housing finance meltdown, this extended program will examine causes of and cures for troubled real estate transactions. The first panel, "Securitization: Problems with Incentives and How to Cure Them" (Bogart, Arnold, Eggert, Plank) will discuss the strengths and weaknesses of securitization as well as possible adjustment of transactional models to align incentives with desirable social policy. The second panel, "Affordable Housing: Ends and Means" (Braucher, Dickerson, Tracht) will address policy ends and means, particularly whether homeownership has been oversold and the costs imposed by local control of land use and construction standards. The final panel, "Bankruptcy Modifications and Other Possible Remedies for Failed Transactions" (Jacoby, Levitin, Scarberry) will debate whether new tools are needed to deal with failed real estate transactions, in or out of bankruptcy, including bankruptcy modification of home mortgages.
