“Courts: At the Margin or the Core?” explores the propriety of federal court centrality in Civil Procedure. Scholars share empirical research revealing state court dominance, examine the contested nature of legal authority between tribal courts and others, grapple with the use of bankruptcy courts to resolve mass claims and aggregate litigation, and center small claims and other lawyerless courts in the civil justice system.
