    This session will explore the role of scholarly disagreement in Islamic and Jewish Jurisprudence. Both legal traditions reflect a legal culture wherein difference of opinion is not simply to be tolerated, but rather an important aspect of each respective tradition’s approach to legal reasoning. These legal traditions demonstrate an appreciation of difference which resulted in an adeptness at addressing the needs of people in different times and places. In our contemporary climate of political and legal discord, perhaps the Jewish and Islamic legal traditions can provide useful models for the decorum and acceptance of differences of opinion.
