Lawyers are being scrutinized, with some referred for discipline, for advising and assisting former President Trump in his efforts to overturn the 2020 election. Notably, the duties of lawyers in government service or who advise government officials are often not directly or clearly addressed by the Model Rules of Professional Conduct. What duties do lawyers owe to constitutional governance? This panel will explore lawyers’ duties in these contexts and the potential need for clarification of the rules of professional conduct.
