New ABA Standard 208 requires law schools to “encourage and support the free expression of ideas” including “ideas that may be controversial or unpopular, including through robust debate, demonstrations or protests. What are law faculty and administrators to do when students report that they are “unsafe” because of speech in the classroom or extracurricular activities? In this session, we will explore strategies for responding to create brave spaces in and outside the classroom that foster critical thought, open exchange of ideas, and vigorous discourse that leads to greater understanding across difference.
