Employers play a critical role in the provision and administration of health and disability insurance in the U.S. Despite decades of state and federal attempts at reform, there are serious concerns about access, cost, coverage, transparency, and enforcement of rights within employer-sponsored plans. In recent years, scholars have begun to examine more closely the incentives of the intermediaries involved in the provision and funding of employer-sponsored benefits, the intersection of state and federal law in the regulation of health and disability insurance, and the application of fiduciary principles under the Employee Retirement Income Security Act (ERISA) to such plans.
