The Supreme Court‘s decision in Crawford v. Washington nine years ago brought about a revolution in the Court’s Confrontation Clause jurisprudence. In the years since Crawford, the Court has struggled with the actual implementation of its decision, starting with Davis v. Washington. A series of recent decision, including Michigan v. Bryant and Williams v. Illinois have raised questions about the future direction of the Court’s Confrontation Clause jurisprudence. This panel will discuss the possible future developments in the Court’s approach, particularly in the area of expert evidence and in domestic violence cases.
