Trust and estate fiduciaries are legal intermediaries appointed to carry out a grantor’s donative objectives subject to the ongoing and exacting scrutiny of the grantor’s beneficiaries. Proper administration can require fiduciaries to make hard choices when beneficiaries object to the grantor’s original terms or to actions taken by a fiduciary to interpret or enforce the grantor’s mandate. This panel will explore how T&E fiduciaries navigate such conflicts inherent in donative transfers. It will also examine the impact of technology on T&E fiduciary administration and the role of lawyers as fiduciaries when serving as executor or trustee.
