Eight days before the 2020 presidential election, the Republican-controlled Senate confirmed former President Trump’s third Supreme Court nominee. With this capstone to the decades-long reactionary campaign to lock in control of the judiciary, the Court’s following terms have zealously dismantled the jurisprudence associated with radical Reconstruction, the New Deal, and the twentieth century’s civil rights movements. Some commentators argue that the current Supreme Court promises “to bring back some old (and very raw) deals in American law and society.” Others look back before the Lochner era to the “Southern Redemption” that reestablished white supremacy under racial terror and the color of Jim Crow laws—or even further to the Taney Court. Whatever their preferred comparison(s), panelists will critique the dismantling of civil rights law and argue how to protect the promise of “Equal Justice Under Law” despite the triumph of the Federalist Society for Law and Public Policy Studies.
