Amidst Reconstruction, Southern Democrats agitated to “redeem” the South. Their reign of white supremacist terror established Jim Crow. Almost one hundred years later, the civil rights movement promised a Second Reconstruction. As federal law codified formal equality, however, reactionary forces worked to preserve the racial capitalism of white supremacy while seeming to transform it beneath veils like colorblindness and globalization. The January 6 insurrection at the Capitol tore off those veils. Now, amidst the racially disproportionate morbidity and mortality that the COVID-19 pandemic illuminates and exacerbates, legal scholars must dismantle the racial capitalism that profits from anti-vaccination rhetoric and politics.
