In February 2024, an abandoned set of residential high-rise towers in Los Angeles became a haven for graffiti artists. The Visual Artists Rights Act (VARA) gives some rights to these artists in protecting their artwork, but then, of course, the real property owners may want to destroy it to protect their ability to resell the real estate. Due to a successful claim by graffiti artists in New York, the number of VARA claims is surging. This panel will explore how the courts have and should evaluate the rights at play.
