On Title IX’s 50th Anniversary, the Biden administration published a Notice of Proposed Rulemaking (NPRM) in response to the previous administration’s 2018 rulemaking, dealing with sexual harassment, transgender rights, and reproductive health. This program brings together scholars who have written extensively about these topics, including via comments filed in response to recent Title IX NPRMs and in litigation challenging the 2018 rules under the Administrative Procedures Act. Panelists will comment on any rules finalized by January 2024, as well as the implications for administrative law and American democracy, the ongoing culture wars regarding transgender students, and the criminalization of abortion.
