College sports have taken a new and potentially decisive turn. Within the past year, a number of states have passed or introduced laws that permit college athletes to receive financial remuneration for exploiting of their rights of publicity. The NCAA has responded by creating a task force that will probably recommend adopting changes to NCAA rules that presently prohibit such remuneration. This dynamic raises a number of legal and regulatory questions about definition and feasibility of amateurism in college sports going forward, including the constitutionality of such regulation, antitrust issues, and accommodations between conflicting regulatory regimes.
