The remedy of nominal damages is having its moment in the sun. Last term, the Supreme Court decided Uzuegbunam v. Preczewski, a case about standing to seek nominal damages. What exactly are nominal damages for? Does the answer vary between private law and public law, including public interest litigation? And how does this remedy intersect with Article III standing requirements? These questions will be considered in this program on nominal damages.
