Leaders in many South Asian countries continue to contravene commonly held democratic freedoms and institutions. Historically, apex courts in several South Asian countries were at the forefront of protecting democracy. Today courts across South Asia have become one of the few institutions that can potentially restrain political leaders. However, they have had uneven success in defending democracy. This panel draws upon in-depth research of courts from a range of South Asian countries to examine the role of the judiciary in countering encroachments on democratic institutions and functions.
