    Legal mechanisms for private civil rights enforcement are facing growing challenges. The U.S. Supreme Court has dramatically narrowed the Bivens Remedy, leaving few effective causes of action for rights violations against federal officials. The defense of qualified immunity has come under increasing scrutiny from both proponents and opponents of the doctrine. The existence and scope of substantive rights, including due process protections, are increasingly under attack. This panel will explore both cutting-edge research and the practicalities of the future of private civil rights enforcement in federal and state courts, as well as other judicial and non-judicial forums.
