A concern for democracy has a long pedigree in antitrust law. As Brandeis declared: "We must make our choice. We may have democracy, or we may have wealth concentrated in the hands of a few, but we cannot have both." That focus, however, has not translated into a concrete mandate in statutory language or agency guidance that "democracy preservation" be a focus of antitrust enforcement actions. Should it? Please join us for a discussion on the effects of corporate concentration on democracy, and the desirability and feasibility of more explicitly focusing on democracy preservation as an antitrust goal.
The Section held a virtual business meeting prior to the Annual Meeting.
