    The session will provide an overview of Section 22 of the Third Restatement of Torts: Remedies, highlighting enhancements from the Second Restatement, particularly on the relationship of dignitary harm to presumed damages and emotional distress damages. Panelists then will examine discrete applications and perspectives, including dignitary harm resulting from violation of constitutional rights; challenges created by artificial intelligence (such as deepfakes) and data privacy; and distributional effects of dignitary harms on certain populations and potential for weaponization against marginalized groups.
