The incoming presidential administration has suggested several new policies that raise significant questions about the strength and scope of U.S. separation-of-powers and civilian control of the military. What are the outer limits of presidential power over our national security apparatus, especially regarding uniform servicemembers? When and under what circumstances can or should members of the military disobey orders from superiors or the president, particularly when those orders involve actions against US citizens or a coup against the government? This roundtable will discuss the constitutional power of the presidency and the military in the post-2024 election context and comparative civ-mil approaches to legal and governmental regimes.
