Miranda v. Arizona is among the Supreme Courts most iconic and, for many, celebrated decisions. But Miranda has always had its detractors. Mirandas critics gained significant ground in the federal judiciary in recent years, culminating so far in the Court's 2022 decision in Vega v. Tekow, which not only held that Miranda violations cannot furnish the basis for a section 1983 action but also suggested that the Miranda rule lacks firm foundations in constitutional doctrine. This panel examines the present and future stature of the Miranda rule as administered by the Roberts Court.
