This panel will highlight the practice of “judge shopping” and broader practices of forum shopping. With judge shopping, plaintiffs (often states) seek to challenge–and obtain national injunctions against–federal executive actions in politically controversial areas by maneuvering for assignment to a specific judge with well-known political leanings. The broader practice of forum shopping, in which litigants choose where to file suit based on their perceptions of how favorably their claims will fare in a particular jurisdiction—has long been debatable. This panel will highlight contemporary developments and longstanding controversies.
