The Supreme Court is committed to
textualist methods of interpreting statutes, a trend that is reshaping the interpretation
of statutes throughout the judiciary. Increasingly, the Court is elaborating
its vision of this interpretive methodology, such as in recent efforts by
textualist Justices to define textualism as the search for the “original public
meaning” of statutes. This session will examine these trends in statutory
interpretation, in the effort to foster a dialogue about how statutes are
interpreted in this emerging era of “high textualism.”
